1. About the Service

MyWhatsApp Clinic is a SaaS platform operated by Arun Pradhan (Mumbai, India) that provides WhatsApp-based appointment booking, patient management, and clinic dashboard tools for healthcare providers.

2. Eligibility

This service is for registered healthcare professionals (doctors, dentists, clinics) and clinic managers in India, aged 18+, legally authorised to enter into this agreement on behalf of their clinic.

3. Account and Access

• Each clinic receives a unique dashboard key — keep this confidential.
• You are responsible for all activity under your account.
• Notify us immediately at +91 81086 64169 if you suspect unauthorised access.
• We reserve the right to suspend accounts that violate these terms.

4. Free Trial

New clients receive a 7-day free trial with full access to all features. No payment is required to start the trial. At the end of the trial, a subscription plan must be selected to continue service.

5. Payments and Pricing

• One-time setup fee: ₹1,499 — covers bot configuration, dashboard setup, and onboarding.
• Monthly subscription: charged as per the selected plan, shown on our website.
• All prices include applicable GST. Payments are due in advance.
• Access may be suspended after a 7-day grace period for non-payment.

6. Acceptable Use

You agree NOT to use the service to send spam, collect patient data beyond appointment management, misrepresent your clinic, violate any Indian law, or attempt to reverse-engineer or resell the platform.

7. Patient Data Responsibility

You (the clinic) are the data controller for your patients' data. MyWhatsApp Clinic acts as a data processor. You are responsible for obtaining patient consent to contact them via WhatsApp and complying with all applicable healthcare and data protection regulations.

8. WhatsApp and Meta Compliance

Use of this service is subject to WhatsApp Business Policy. You agree to only message consenting patients and comply with all Meta messaging policies. We are not responsible for service disruptions caused by Meta/WhatsApp platform changes.

9. Service Availability

We aim for 99% uptime but do not guarantee uninterrupted service. We are not liable for losses arising from temporary unavailability.

10. Intellectual Property

All software, designs, and content of MyWhatsApp Clinic are owned by Arun Pradhan. You receive a limited, non-exclusive licence to use the service during your subscription. You may not copy, distribute, or create derivative works.

11. Limitation of Liability

To the maximum extent permitted by law, MyWhatsApp Clinic shall not be liable for loss of revenue, data loss due to events beyond our control, Meta/WhatsApp platform actions, or any indirect or consequential damages. Our total liability shall not exceed fees paid in the 3 months prior to the claim.

12. Termination

• By you: Cancel anytime via WhatsApp or email. No further billing after cancellation.
• By us: We may terminate accounts that violate these terms, with or without notice.
• Upon termination, you may request a data export within 30 days, after which data may be deleted.

13. Governing Law

These terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.

14. Changes to Terms

We may update these terms with 14 days' notice via WhatsApp or email. Continued use after the notice period constitutes acceptance.
